This website is operated by Cacele, the owner and operator of Shaperack. Throughout the site, the terms “we,” “us,” and “our” refer to Cacele and Shaperack. By visiting https://shaperack.com, purchasing from us, creating an account, contacting us, or using any part of our website, you agree to these Terms of Service.

If you do not agree to these Terms, do not use our website or purchase from Shaperack.

1. Online Store Terms

Shaperack is a U.S.-based online store operated from Saint Augustine, Florida. We sell shapewear, apparel, accessories, and related products through an online storefront powered by Shopify and supported by third-party payment, fulfillment, shipping, and supplier services.

You must be at least the age of majority in your state or place of residence to use this site or make a purchase. You agree not to use our products or website for any unlawful purpose.

2. Products, Sizing, and Product Information

We make reasonable efforts to display products, colors, sizes, descriptions, pricing, availability, and images accurately. However, we do not guarantee that product descriptions, images, colors, measurements, availability, or other content will always be complete, current, or error-free.

Colors may appear differently depending on your screen, lighting, device, and display settings. Measurements may vary slightly due to manufacturing differences. You are responsible for reviewing product descriptions, size charts, shipping information, and order details before purchasing.

Shapewear fit and results vary by body type, sizing choice, garment style, and personal preference. We do not guarantee any specific body shape, appearance, compression level, comfort result, medical benefit, or fitness result.

Products sold on Shaperack are not medical devices and are not intended to diagnose, treat, cure, or prevent any condition. If you are pregnant, postpartum, recovering from surgery, managing a medical condition, or unsure whether compression apparel is appropriate for you, consult a qualified healthcare professional before use.

3. Orders and Acceptance

Placing an order does not guarantee acceptance. We reserve the right to refuse, cancel, limit, or modify any order for any reason, including suspected fraud, payment issues, inventory problems, supplier issues, shipping restrictions, pricing errors, product listing errors, or violation of these Terms.

If we cancel an order after payment has been captured, we will issue any required refund to the original payment method.

You are responsible for providing accurate billing, shipping, contact, and payment information. We are not responsible for delays, failed delivery, lost packages, or additional costs caused by incorrect or incomplete information provided by you.

4. Prices, Payments, and Billing

Prices are listed in the currency displayed at checkout and may change without notice. We reserve the right to correct pricing, product, discount, or availability errors at any time, including after an order is submitted.

Payments are processed through Shopify and third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method provided.

Discount codes, promotions, and offers are subject to change, cancellation, expiration, and additional conditions at our discretion. Unless stated otherwise, promotions cannot be combined, applied retroactively, exchanged for cash, or used after expiration.

5. Shipping and Delivery

Shipping times shown on our website are estimates unless expressly stated as guaranteed. Processing time, supplier handling time, carrier delays, customs, weather, holidays, address issues, and other factors may affect delivery.

Some products may be fulfilled directly by third-party suppliers, warehouses, logistics providers, or dropshipping partners, including CJ Dropshipping where applicable. Products in the same order may ship separately.

Once an order has shipped, carrier tracking controls delivery status. If tracking shows that a package was delivered, we generally treat the order as delivered. We are not responsible for theft, loss, misdelivery, refusal, failure to pick up, or address issues after carrier-confirmed delivery, except where required by law.

If we cannot ship within the timeframe required by applicable law, we will follow legally required delay notice, cancellation, or refund procedures.

6. Returns, Refunds, and Exchanges

All purchases are subject to our Return & Refund Policy, which is incorporated into these Terms.

Except where required by law or expressly allowed by our Return & Refund Policy, all sales are final. We do not guarantee returns, exchanges, refunds, or cancellations for buyer’s remorse, wrong size selection, wrong color selection, change of mind, refusal of delivery, failure to pick up a package, ordinary shipping delays, or minor product differences that do not affect normal use.

Do not send any product back without written authorization from Shaperack. Unauthorized returns may be refused and do not create refund eligibility.

7. Final Sale and Hygiene-Sensitive Products

Because many Shaperack products are intimate apparel, shapewear, undergarments, compression garments, or body-contact products, returns may be limited or denied for hygiene, safety, supplier, and resale reasons.

Items that are worn, washed, used, damaged after delivery, missing tags, missing packaging, altered, stained, scented, or otherwise not in original condition are not eligible for return unless required by law.

8. Account Information

You may be able to create an account or use customer account features through Shopify or related services. You are responsible for maintaining the confidentiality of your account access and for all activity under your account.

We may suspend or terminate account access if we believe there has been fraud, abuse, misuse, unauthorized activity, or violation of these Terms.

9. Prohibited Uses

You agree not to use the website or services to:

• Violate any law, regulation, or third-party right.
• Submit false, misleading, fraudulent, or unauthorized information.
• Interfere with website security, payment processing, checkout, or store operations.
• Scrape, copy, reproduce, resell, or exploit the website or content without permission.
• Upload malware, spam, or harmful code.
• Harass, abuse, defame, threaten, or discriminate against others.
• Attempt to bypass fraud prevention, purchase limits, access controls, or security systems.

We reserve the right to terminate your use of the site for violating these prohibited uses.

All website content, including text, graphics, logos, images, layouts, product presentation, design elements, and other materials, is owned by or licensed to Cacele, Shaperack, Shopify, suppliers, or other rights holders.

You may not copy, reproduce, distribute, modify, sell, exploit, or use our content for commercial purposes without written permission.

12. User Content and Reviews

If you submit reviews, photos, comments, feedback, suggestions, or other content, you grant us a worldwide, royalty-free, transferable, sublicensable right to use, reproduce, edit, publish, display, distribute, and promote that content in connection with Shaperack.

You agree that your content will not be unlawful, false, misleading, defamatory, obscene, abusive, infringing, or otherwise harmful. We may remove or edit user content at our discretion.

13. No Warranty

To the fullest extent permitted by law, Shaperack and all products and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

We do not guarantee that the website will be uninterrupted, secure, error-free, current, or free from viruses or harmful components. We do not guarantee that products will meet every expectation, fit preference, compression preference, body-shaping expectation, or personal result.

14. Limitation of Liability

To the fullest extent permitted by law, Cacele, Shaperack, and our service providers, suppliers, affiliates, contractors, employees, and partners will not be liable for indirect, incidental, punitive, special, consequential, or similar damages arising from your use of the website, purchase of products, shipping delays, product use, inability to use products, or reliance on website information.

To the fullest extent permitted by law, our total liability for any claim related to an order will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Cacele, Shaperack, and our service providers, suppliers, affiliates, contractors, employees, and partners from any claim, demand, loss, liability, damage, cost, or expense, including reasonable attorneys’ fees, arising from your violation of these Terms, misuse of the website, misuse of products, violation of law, or infringement of another person’s rights.

16. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including supplier issues, carrier delays, customs delays, labor disputes, natural disasters, severe weather, pandemics, government actions, war, civil unrest, internet outages, platform outages, payment processor issues, or other events outside our control.

17. Governing Law

These Terms and any dispute relating to Shaperack, purchases, products, or website use will be governed by the laws of the State of Florida, without regard to conflict-of-law rules, except where applicable consumer protection law requires otherwise.

18. Dispute Resolution

Before filing a claim, you agree to contact us at support@Cacele.com and give us a reasonable opportunity to resolve the issue informally.

To the fullest extent permitted by law, any dispute must be brought individually and not as part of a class, consolidated, collective, or representative action. Nothing in this section limits rights that cannot be waived under applicable law.

19. Changes to These Terms

We may update, change, or replace these Terms at any time by posting a new version on this page. The updated version will apply after it is posted. Your continued use of Shaperack after changes are posted means you accept the updated Terms.
